Raw and unprocessed agricultural produce falls under Class 31, which covers fresh fruits and vegetables, grains and seeds, live plants and flowers, and seedlings for planting.

Why processing changes the class

The line that matters here is raw versus processed. Fresh, unprocessed produce sits in Class 31. The moment a product is cooked, preserved, packaged as a prepared food, or otherwise processed, it shifts to a different class — typically Class 29 for processed fruits, vegetables, and animal-origin foods (see our dairy products entry), or Class 30 for grain-based and bakery products. A farm brand selling both fresh produce and a processed product line, like pickled vegetables or packaged flour, under the same name would need both classes.
